KENNETH

Kenneth Yim advises on tax-efficient strategies with respect to doing business or investing in Asia involving Hong Kong.  Conversely, he also advises Asian entrepreneurs and investors expanding into Western countries.

Typically, Kenneth applies a solution-based approach in providing advice to clients.  His international tax planning experience includes a broad range of matters for both corporate and private wealth clients, including but not limited to tax considerations relating to private equity, M&A, wealth management, estate planning, family offices, (re)financing, intellectual property, real estate, e-commerce and employment, usually in a cross-border context.  In addition, he has considerable experience in negotiating advance tax rulings, handling tax investigations, and resolving disputes with tax authorities.

Kenneth’s previous work experience includes Head of Tax positions at an independent law firm and a global professional services firm in Hong Kong. Before relocating to Hong Kong in early 2011, he worked as a tax lawyer in the Netherlands (including a secondment to the United States) where he developed a particular interest and experience in tax structuring with respect to Western and Asian inbound and outbound transactions.

On the academic side of professional practice, Kenneth is the global managing editor of IBFD’s online collection ‘Investment Funds and Private Equity’ covering 25 jurisdictions. He has also been a regular contributor to their publications on international tax matters involving Hong Kong.

Kenneth graduated at Tilburg University with Master of Laws (LL.M.) degrees in both tax law and civil law in 2005, respectively, 2006. Subsequently, he qualified with the Dutch Association of Tax Advisors (‘Nederlandse Orde van Belastingadviseurs’) which is the only professional body of university educated tax specialists in the Netherlands.  He is also a member of CFE Tax Advisers Europe, the International Fiscal Association and the International Bar Association.

In addition to fluency in English and Cantonese, Kenneth is also a native Dutch speaker.

DAVID

Based in Frankfurt (Germany), attorney-at-law and certified tax advisor Dr. David Witzel advises multinational companies and their shareholders with respect to all corporate law and tax law matters.  He has extensive experience in the areas of estate planning, M&A transactions and international tax structuring.

In particular, Dr. David Witzel’s expertise includes counselling on private equity, real estate and all legal issues in connection with the structuring of estates and investments.  Notably, he has advised Asian families on their investments into Germany, family offices (from the US and Germany) on estate and succession planning involving Asian assets, US multinational corporations in respect of international tax structuring matters including their Asian operations, and various co-founders of an Asian e-commerce giant on their participation in stock incentive programs.

Concurrently with his role as special counsel to Kenneth Yim Tax, Dr. David Witzel is the founding partner of the German law firm Dr. Witzel & Partner in Frankfurt (www.witzel-law.com). 

Previously, he was a lawyer at among others US law firm Debevoise & Plimpton LLP and KPMG for many years.  Dr. Witzel is co-author of several tax handbooks and publishes articles in reputed law and tax journals.  Moreover, he holds lectures on different occasions at universities.

Dr. Witzel studied at the University of Heidelberg in Germany and he made his clerkship in Berlin before he finalized his PhD.  Subsequently, he studied at the University of Sydney where he achieved a Master of Laws (LL.M.) degree.

ROHIT

Rohit advises businesses on indirect tax matters including business modelling, cost evaluation, sourcing and manufacturing planning. He has over 15 years of experience providing international trade and related tax advisory/support (such as customs, GST/VAT/consumption tax, excise, withholding tax and tax audits) to multinational corporate clients.

Rohit has worked in some of the major markets in the APAC region (China, India, and Southeast Asia) on a broad range of trade and indirect tax issues affecting regional and global trade for companies doing business in Asia.

Rohit’s key strengths include advising on cross-border transactions, market entry analysis involving customs, consumption taxes, business modelling for procurement including the use of FTAs for lower duty cost, contract manufacturing/processing trade modelling for cost optimization, customs bonded zone operations, etc., with the goal of keeping the cost of operations low and maximizing profits. He also has extensive experience in sales tax/VAT planning and compliance for e-commerce and retail operations.

Rohit is a qualified India chartered accountant and also has a Bachelor in Commerce with Honors. He is fluent in English and speaks basic Mandarin.

YAN

Yan assists Kenneth in providing expert tax advice and solutions to a diverse range of clients, helping them in setting up their business and investing in Asia involving Hong Kong.

Yan has over 5 years of working experience in the field which includes providing tax advice for individuals and businesses, applying for tax residency certificates, preparing Country-by-Country reporting, replying to the Hong Kong tax authority’s enquiries and other tax compliance issues, etc.  She has assisted clients from various industries including finance, manufacturing and retail, in optimizing their tax strategies and ensuring compliance with all relevant tax obligations.  Yan has demonstrated a deep understanding of Hong Kong's tax laws and regulations, enabling her to navigate the local tax regime with ease.

Yan has a bachelor’s degree in professional accounting with Honor from the Hong Kong University of Science and Technology.  She is fluent in English, Mandarin, and Cantonese.

TRACY

Tracy provides Hong Kong tax advisory and compliance services for both companies and individuals.

Tracy’s experience includes advising on the establishment and operational matters of Hong Kong companies in respect of cross-border investments and technology businesses. She also deals with tax matters relating to the employment of directors and staff in Hong Kong.

Tracy holds a bachelor's degree in accounting from the University of Science and Technology in Hong Kong. She is a native Cantonese speaker, and fluent in Mandarin and English.
